CIVIL LITIGATION

When an individual commits a criminal "wrongful" act, the government files a Criminal Complaint against that person. Civil law suits are the counterpart to Criminal Complaints. In a civil suit, one party or parties sues another party or parties, alleging some type of "civil" wrong and asking the court to grant damages or some other form of relief.

Civil litigation is as broad and varied as life itself. We see law suits for $10.00 and law suits for millions--even billions of dollars. The subject might be that coffee was served too hot without a sufficient warning, or involve an insurance carrier that is refusing to honor the terms of its policy.

A civil law suit is our modern way of obtaining help for one who has been “wronged” by another. Generally, we are asking the Court to make one party pay a certain amount of money to the other party, but sometimes we are asking for the Court to order a party to cease certain forms of activity or to simply make a declaration as to who actually owns a parcel of real property, or to declare the rights and duties of parties to a contract.

All civil suits regardless of amount or subject matter follow a certain pattern:

Complaint – Response- Meeting of Counsel-Disclosure of Documents – Discovery – Trial & Judgment

Prior to filing a lawsuit, you must ask several critical questions:

Have I been wronged in a legal sense?

Do I have the evidence to prove my case?

Can I recover from the defendant if I win my case?

Is the expected recovery worth the costs I will incur?

Our policy is to discourage clients from filing cases unless we sincerely believe it will be to the client’s advantage.

If you are sued, the advice is quite different. Even if you correctly believe that the case against you has no merit, if you ignore the law suit, a judgment will most likely be entered against you in the amount sought by the plaintiff.
